13. Hosting and managed infrastructure
If we provide hosting as part of a managed plan, the hosting is provided for the website and plan described at purchase or in the written agreement.
You agree not to use managed hosting for:
- illegal content or activity

We may suspend or limit hosting if we believe there is a security risk, legal risk, abuse, non-payment, excessive resource usage, or violation of these Terms.
Hosting environments may use third-party infrastructure providers. We are not responsible for outages, limitations, or failures caused by third-party providers, internet infrastructure, DNS providers, domain registrars, or services outside our control.
14. Backups
Managed plans may include backups according to the plan description.
Backups are a safety measure, but they are not a guarantee against data loss.

Custom development is usually based on a written scope, quote, estimate, proposal, or agreed task list.
Unless expressly stated, estimates are not fixed guarantees. If project requirements change or additional issues are discovered, cost and timeline may change.
You are responsible for reviewing deliverables and giving timely feedback.
If you delay feedback, approvals, access, content, or required information, project timelines may be extended.
17. White-label WordPress Development
White-label services are intended for agencies, freelancers, and businesses that need WordPress work delivered behind their own brand.
Unless otherwise agreed in writing:
- we act as your subcontractor
- you remain responsible for your client relationship
- you are responsible for client communication
- you are responsible for collecting requirements and approvals from your client
- you are responsible for ensuring you have permission to share client information, access, files, and project materials with us
- we do not communicate directly with your client unless agreed
- we may treat project details as confidential
White-label work does not create exclusivity unless expressly agreed in writing.
18. Website reviews and consultations
We may offer free or paid website reviews, consultations, audits, or recommendations.
A free review is a high-level assessment and does not guarantee that we will find every issue.
Any recommendations are based on the information available to us at the time. They are not a guarantee of performance, ranking, revenue, security, or business results.
A website review does not create an obligation for either party to proceed with paid work.
19. Customer responsibilities
You are responsible for:
- providing accurate information
- providing required access in a timely manner
- keeping your own login credentials secure
- maintaining your own backups unless backup management is included in your plan

20. Access credentials
If you provide website, hosting, server, FTP, SFTP, SSH, database, domain, email, API, or third-party service access, you authorize us to use that access as necessary to provide the agreed Product or Service.
You should provide access through secure methods whenever possible.
We recommend creating temporary or limited-access accounts for us where possible.
You are responsible for removing or changing access after the service ends unless access management is included in an ongoing plan.
21. Third-party products and services
Our Products and Services may integrate with or depend on third-party products and services, such as:

- WPBakery
- Gutenberg

- hosting limitations
- third-party account suspensions
If a third-party service changes or stops working, additional paid work may be required to modify, replace, or repair related functionality.
22. Elementor Pro and other third-party licenses
Some managed plans or services may include access to third-party tools, such as Elementor Pro, only while the relevant plan is active and only for the website covered by that plan.
Unless expressly stated, third-party licenses provided as part of a managed service remain under our account or provider arrangement and are not transferred to you.
If your plan ends, access to third-party tools provided through the plan may stop. Your website may require your own license to continue receiving updates, support, or premium features from that third-party provider.
23. Payments
Prices are shown on our Website, checkout page, invoice, proposal, or written agreement.
You agree to pay all fees associated with your Order, Plan, or Service.
Unless stated otherwise:
- prices are in the currency shown at checkout or on the invoice
- taxes may be added where applicable
- payment is due before delivery, subscription activation, or project start
- unpaid invoices may delay or stop work
- late or failed payments may result in suspension or cancellation of services
We may use third-party payment processors or checkout providers. Their terms and policies may also apply.
24. Taxes
You are responsible for any taxes, VAT, sales tax, use tax, withholding tax, duties, or similar charges that apply to your purchase, except taxes based on our income.
Where required, taxes may be calculated and collected at checkout.
If you provide incorrect billing, tax, VAT, company, or location information, you are responsible for any consequences, additional charges, or corrections required.
25. Subscriptions, renewals, and cancellations
Some Products and Services are sold as recurring subscriptions.
By starting a subscription, you authorize us or our payment provider to charge you on a recurring basis according to the plan terms shown at checkout, invoice, or agreement.
Subscriptions may renew automatically unless cancelled before the renewal date.
You may cancel a subscription according to the cancellation process available in your account, checkout provider portal, or by contacting us.
Cancellation stops future renewals. It does not automatically refund past payments unless required by law or allowed by our refund terms.
If a subscription is cancelled, expires, or payment fails, we may suspend or terminate access to:
- downloads
- updates
- support
- managed services
- hosting
- third-party licenses included in the plan

- cancel the subscription
- terminate access to plan benefits
We are not responsible for service interruption caused by failed, expired, declined, disputed, or reversed payments.
27. Refunds
Refund terms depend on the type of Product or Service purchased.
Digital theme purchases
Because WordPress themes and digital downloads can be accessed immediately, refunds may be limited once a theme has been downloaded, accessed, or delivered.
We may offer a refund if:
- you were charged incorrectly
- you purchased the same product twice by mistake
- the product has a serious technical issue that we cannot resolve within a reasonable time
- a refund is required by applicable law
We generally do not provide refunds because:
- you changed your mind after download
- you no longer need the theme
- you expected features not listed on the product page
- your hosting, WordPress setup, or plugins are incompatible
- you do not have the technical knowledge to use WordPress
- you modified the theme or files
- a third-party plugin caused a conflict
- you refused reasonable support or troubleshooting steps
All Themes Package
The All Themes Package is a yearly digital subscription. Refunds may be limited once access to the package, downloads, or updates has been provided.
If required by law, we will honor applicable consumer rights.
Managed websites and monthly support
Subscription fees for managed websites and monthly support are generally non-refundable once the service period has started, unless required by law or agreed otherwise in writing.
If you cancel, cancellation usually applies to future billing periods, not already-paid periods.
Custom development and white-label work
Payments for custom development, white-label work, setup work, and project work are generally non-refundable once work has started.
Deposits, milestone payments, and completed work are non-refundable unless required by law or agreed otherwise in writing.
If a project is cancelled after work has started, you are responsible for paying for work completed, time spent, third-party costs, and any non-cancellable commitments.
Chargebacks and disputes
If you open a payment dispute or chargeback without contacting us first, we may suspend your account, downloads, support, subscriptions, managed services, hosting, and ongoing work while the dispute is investigated.
28. Consumer withdrawal rights
If you are a consumer in a country that gives you a legal right of withdrawal, you may have the right to cancel certain online purchases within a legal withdrawal period.
However, legal withdrawal rights may be limited or lost for digital content or digital services when:
- you expressly consent to immediate delivery or performance, and
- you acknowledge that you may lose your withdrawal right once delivery or performance begins, where allowed by law.
For digital downloads, theme files, All Themes Package access, managed services, support, setup work, or custom development, we may ask you at checkout or before service begins to consent to immediate delivery or performance.
Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.
29. Delivery

Services are delivered according to the applicable plan, proposal, ticket, project scope, or written agreement.
Delivery times may vary based on:
- payment confirmation
- customer access
- project complexity
- customer feedback
- third-party dependencies
- workload
- holidays and weekends

We are not responsible for delivery delays caused by incomplete information, missing access, payment issues, third-party services, or customer delays.
30. Changes to products, services, and pricing
We may update, modify, improve, discontinue, or replace Products and Services from time to time.
We may also change prices, plan features, package contents, support terms, and service availability.
Price changes for subscriptions will apply according to the notice or renewal terms provided to you where required.
If a Product or Service is discontinued, we may stop selling it, but existing customer rights will be handled according to the applicable purchase terms and legal requirements.
31. Intellectual property
All intellectual property rights in our Website, Products, themes, code, designs, documentation, graphics, text, branding, logos, layouts, and related materials belong to us or our licensors.
You may not copy, resell, redistribute, sublicense, reverse engineer, or create derivative products from our Products except as permitted by these Terms or a written agreement.
You retain ownership of your own content, such as text, images, logos, media, and business materials that you provide to us.
By providing content or materials to us, you grant us permission to use them as necessary to provide the Products or Services.
32. Portfolio use
Unless you request otherwise in writing, we may mention your business name, website, logo, or project in our portfolio, case studies, marketing materials, or client list after the project is public.
For white-label work, we will not publicly disclose the end client or present the work as ours if confidentiality or white-label restrictions have been agreed.
If you do not want us to reference your project publicly, please notify us in writing.
33. Confidentiality

Confidential information may include business information, login details, technical information, project plans, client details, pricing, non-public materials, or other information that should reasonably be understood as confidential.

35. No guarantees of business results
We work to provide high-quality Products and Services, but we do not guarantee specific business results.
We do not guarantee:
- search engine rankings

Any estimates, recommendations, audits, or advice are provided based on available information and professional judgment.
36. Disclaimer of warranties
To the fullest extent permitted by law, our Website, Products, and Services are provided “as is” and “as available”, unless expressly stated otherwise.
